Accident At Work
These can occur in any job, and in any situation. All employers have a duty to provide safe and secure working conditions, and if they do not then they may be breaking the law, and putting you at risk.
Each employer has various responsibilities to their employees to make sure their working environment and conditions are safe, and that the risk of any accident whilst working is minimal. Compliance with these responsibilities not only protects workers, but prevents work accident claims being pursued against employers.
These responsibilities are varied in accordance with the working environment and each trade or profession will have their own set of occupational risks which need to be dealt with and supervised by the employer.
A workplace may take on a multitude of different forms, such as working from a van or car if driving is part of the employee’s job. In this example, the vehicle provided to carry out the employee’s duty would need to be safe and roadworthy.
If the vehicle that is provided is unsafe, and the driver sustains an injury from an accident which occurs as a direct result of the vehicle being unfit for purpose then, the driver could be entitled to make a claim for work accident compensation.
If an employer doesn’t provide safety precautions at work to guard against accident risk, they will increase the probability of their employees sustaining a work or industrial injury and, in consequence, the possibility of compensation claims being made against them.
Simply accident at work claims are for injuries that the employee suffered whilst at work or carrying out work duties on the employers behalf, which wouldn’t have occurred but for the employer taking the recommended and appropriate action to prevent the work accident.
The employer has duties to comply with Health and Safety legislation that has been created to make the workplace a safer environment, and thereby reduce the risk of any work accidents occurring.
To prove that the employer was responsible for any work accident requires a in-depth knowledge of the rules and regulations that apply to work accident claims.
SAM have specialist Solicitors who are experts in Health and safety Legislation and can advise the client on if they have a claim against their employer following an accident at work.
