Personal Injury compensation should be received as a result of making a successful personal injury claim. The compensation is frequently in two parts.
The first part is damages or compensation for the injuries pain and suffering. This is called "General Damages", and is valued by your solicitor by referring to other similar cases.
The second part is damages as recompense for financial losses and expenses you have suffered
( or may suffer in the future) as a result of the accident. Typical examples of this type of compensation (known as "Special Damages") are loss of earnings, and the cost of treatment, medication and nursing care. If agreement cannot be reached with the other side - usually an insurer - about the claim, then a Court would have to hear all the evidence and make an award.
